UPHOLSTERED FABRICS*

Fabric and leather are warranted to be free of defects in materials and workmanship for one year from the date of sale. This warranty covers seam failure, fabric separation and nap loss. This warranty DOES NOT apply to pilling, fading, shrinking, dye lot variations, tears, scratching, fraying, stretching, wearing or flattening of the nap. Chenilles, velvets, and velvet-types have an inherently soft texture and will shade, crush and mark more easily than most fabrics. These characteristics are not considered to be a defect. Also excluded are damages and defects resulting from abuse, neglect, exposure to extreme temperatures or pet damage. Natural markings such as scars, brands, grain variations, wrinkles, etc. will be considered normal characteristics and not construed as defects. No two leather hides are ever the same so color variations could occur. Upon evidence of excessive soiling, improper cleaning, abuse or chemical application, the fabric/leather warranty will not apply. Franklin Corporation may require proof of damage.

LIMITATIONS ON WARRANTY

The warranty contained herein shall be in lieu of any other warranty, expressed or implied, including but not limited to any implied warranty of merchantability or fitness for a particular use. Liability for incidental or consequential damages under the warranty is excluded. Some states do not allow limitation of incidental or consequential damages; therefore, this limitation may not apply to you. This warranty gives you specific legal rights and other rights which vary from state to state. The following additional limitations to apply to call warranties contained herein:

  • Warranties extend to the original purchaser only and are not transferable.
  • Warranties do not apply to rental, business, commercial, institutional, or other non-residential use.
  • All warranties are subject to availability of repair and replacement parts and limited to one-time replacement. Shipping and handling costs are not included.
Replacement cover dye lots vary from shipment to shipment and may not exactly match the original.
  • Warranties do not apply to any condition caused by damage, improper use or abuse occurring after the date of sale to the original purchaser. Such damage, improper use or abuse will void all warranties.
  • Exceeding weight capacity of 275 lbs will void warranty.
  • Warranties do not apply to closeouts or any other discontinued merchandise.

OUR OBLIGATION

Franklin’s obligation under its warranty is limited to repairing or replacing at Franklin’s discretion any part or parts of the chair covered by warranty that are found to be defective in workmanship or materials upon examination by Franklin or Franklin’s designated agent. Cost of packing and shipping the entire piece to and from the factory, if necessary, is not covered by this warranty. Any merchandise deemed not repairable by the manufacturer will be prorated through the dealer based on the original date of purchase.
